ARTICLE I
IMPORTANT TERMS
This Privacy Policy (“Policy”) contains the terms and conditions that how WhaleFlux, LLC’s online Pro Service matching service platform WhaleFlux (“WhaleFlux” or “it”) treats its user’s privacy (“Member” or “Subscriber”). In this Policy it indicates the information WhaleFlux collects, how WhaleFlux will use such information, and the sharing of such information by WhaleFlux. This Policy will cover and apply to the whole website and related sites, all the applications, and any other services (collectively, “Platform”) made and available to the Member by WhaleFlux. Except as otherwise specifically described herein, this Policy does not include information collected through any other means except obtained through Platform, information collected through other means include but not limited to information collected in person, through the telephone or by physical mail, or from third parties, or any information collected offline. Undefined capitalized terms used herein, if not defined in this Policy are applied with the “Definition” section in the Terms of Use of WhaleFlux.
ARTICLE II
INFORMATION WhaleFlux COLLECTS
WhaleFlux collects information from multiple resources. WhaleFlux will collect information directly from Member; WhaleFlux will collect information from third parties; and, WhaleFlux will collect Meta Data Information (as described below) from Member’s browser or personal devices.

It may also include information specific to Service Member who is offering services to Member through the Platform, WhaleFlux will collect information such as a business name, qualifications and credentials, description of services.
WhaleFlux may collect information about Member or others through governmental agencies or third party service providers which to the extent permitted by law, WhaleFlux may under its sole discretion, request information on Member’s credit information from social security office, credit bureau or other third party service provider to verify Member’s identity, credit or trustworthiness for payment, safety protection and fraud investigation purposes. In order to enforce the Terms of Use and for service and training quality purposes, WhaleFlux may collect communication information between Customer Member and Service Member.
ARTICLE III
META DATA INFORMATION
WhaleFlux and its third party service providers, which include but not limited to advertising networks and analytics companies (e.g. Hotjar, Google Analytics, and others) may collect Member’s browser or personal devices’ meta data information through cookies, web beacons, and other tracking technologies during and after Member’s use or access to the Platform.
As referenced above, WhaleFlux may collect below meta data information:
WhaleFlux will use this information (including the information collected by third-party service providers) for Platform improvement in order to make the Platform a better tool to assist and serve all the Members. WhaleFlux will also use such information for marketing analysis to evaluate the advertising status and strategies.
WhaleFlux may collect location information (e.g. through IP address) during or after Member’s use or access of the Platform. If Member installs WhaleFlux’s application, WhaleFlux may ask Member to grant WhaleFlux access to Member’s mobile device’s geolocation data.
ARTICLE IV
USAGE OF MEMBER’S INFORMATION
WhaleFlux may use Member’s information for any of the following reasons:
WhaleFlux has its absolute and sole discretion to display Member’s information on Member’s public profile for matching Pro Services purposes, including but not limited to Customer Member’s name and Service Member’s business’s name. If there are inconsistencies of information that Member provided to WhaleFlux during registration for the account with the information provided to WhaleFlux later for verification purposes by such Member or any third party service provider, WhaleFlux will have absolute and sole discretion in determining which information will be displayed publicly on Member’s profile. WhaleFlux may aggregates and/or de-identifies information collected through the Platform. WhaleFlux may use aggregated or de-identified information and share such information with any third party service providers for purposes, including but not limited to marketing research, investigation, payment and other purposes.
WhaleFlux may, under its absolute and sole discretion, either directly or through other third party service providers to retrieve and analyze Members’ communications with each other via the Platform for fraud investigation, risk assessment, regulatory compliance, customer support, marketing research, Platform improvement and other purposes. Note, by registering, using and accessing the Platform or engaging in offline communications related to Platform, Member consents that WhaleFlux, under its absolute and sole discretion, may either directly or through other third party service providers to retrieve and analyze Member’s communications.
ARTICLE V
DISCLOSES AND SHARES MEMBER’S INFORMATION
Unless otherwise specifically described in this Policy, WhaleFlux may share Member’s information under follow circumstances (below list is illustrative, not exhaustive):
ARTICLE VI
SHARE MEMBER’S INFORMATION FOR ADVERTISING PURPOSES
WhaleFlux may use third-party web analytics services on the Platform, such as those of Google Analytics. These service providers use the sort of technology mentioned in Meta Data Information section above to help WhaleFlux’s marketing and advertising analysis. The information collected by the technology will be disclosed to or collected directly by these service providers.
WhaleFlux also allows other third parties (e.g., ad networks and ad servers such as Google Analytics, DoubleClick, Facebook and others) to serve tailored marketing to Member and to access their own cookies or other tracking technologies on Member’s personal devices when Member is using or accessing the Platform. WhaleFlux neither has access to, nor does this Policy governs, the use of cookies or other tracking technologies that may be placed on Member’s personal devices when Member is using or accessing the Platform by third-party ad technology, ad servers, ad networks or any other non-affiliated third parties. Those parties that use these technologies may offer Member a way to opt out of targeted advertising. Cookies may be associated with de-identified data linked to or derived from data. Member voluntarily have submitted to WhaleFlux (e.g., Member’s email address) that WhaleFlux may share information with above mentioned third parties.
When using an application Member may also receive tailored in-application advertising content. Each operating system-iOS for Apple devices, Android for Android devices, and Windows for Microsoft devices-provides its own instructions on how to prevent the delivery of tailored in-application marketing content. Member may review the support materials and/or the privacy settings for the respective operating systems in order to opt-out of tailored in-application advertising. For any other devices and/or operating systems, please visit the privacy settings for the applicable device or contact the applicable platform operator.
ARTICLE VII
MISCELLANEOUS
Service of Minor. WhaleFlux’s services are not designed for user under 21. Only persons 21 years of age or older may use the Platform. If WhaleFlux discovers that an individual under 21 has registered an account, WhaleFlux will reject such registration, close the account and delete the personal information to the extent required by the Children’s Online Privacy Protection Act. WhaleFlux may, where permitted by law, retain certain information internally for purposes described in this Policy.
Data Security. WhaleFlux employs physical, procedural, and technological security measures to help protect Member’s personal information from unauthorized access or disclosure. WhaleFlux may use encryption, passwords, and physical security measures to help protect Member’s personal information against unauthorized access and disclosure. However, Member shall note that no security measures, however, are 100% failsafe. Therefore, WhaleFlux does not promise and cannot guarantee, and thus Member should not expect, that Member’s personal information or communications will not be revealed, collected, disclosed and/or used by others. Member should take steps to protect against unauthorized access to Member’s password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping Member’s log-in and password private, and not recycling passwords from other websites or accounts. WhaleFlux explicitly disclaims any responsibility of the unauthorized use, lost or stolen of Member’s information.
External Websites. The Platform may contain links to other websites or resources over which WhaleFlux does not have any control. Such links do not constitute an endorsement by WhaleFlux of those external websites. Member acknowledges that WhaleFlux is providing these links to Member only as a convenience, and further agrees that WhaleFlux is not responsible for the content of such external websites or the protection and privacy of information.
Updating Member’s Information. Member is permitted to edit and delete certain information account information in his/her profile. Member must promptly updates account information the current information becomes inaccurate. Upon Member’s request, WhaleFlux will close Member’s account and remove Member’s profile information from view as soon as reasonably possible. WhaleFlux may retain information from closed accounts in order to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any user, enforce Terms of Use, and/or for any other purposes otherwise permitted by law that WhaleFlux deems necessary in its sole discretion. Member should understand, however, that once Member transmit information through the Platform, Member may not be able to change or remove it. Once WhaleFlux has deactivated or removed Member’s account, Member agrees that WhaleFlux will not be responsible for retaining information related to Member’s account.
Email Communication. WhaleFlux may send periodic emails to Member. Member may opt out of promotional emails by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for ZUUMOO to process opt-out requests. Member may still receive emails about Member’s account or any services Member have requested or received from WhaleFlux.
Amendment to the Policy. THIS POLICY IS CURRENT AS OF THE EFFECTIVE DATE SET FORTH IN THIS POLICY. WhaleFlux MAY, IN ITS ABSOLUTE AND SOLE DISCRETION, CHANGE THIS POLICY AT ANY TIME. WhaleFlux WILL POST ITS UPDATED POLICY ON THE PLATFORM, NOTIFY MEMBER THROUGH EMAIL. WhaleFlux ENCOURAGES MEMBER TO REVIEW THIS POLICY REGULARLY FOR ANY CHANGES. MEMBER’S CONTINUED ACCESS TO OR USE OF THE PLATFORM WILL BE SUBJECT TO THE TERMS OF THE THEN-CURRENT POLICY.
